1. SCOPE OF APPLICATION & DELIMITATION
1.1. Scope of Application
These General Terms and Conditions (GTC) of the Tamina Health Center apply in addition to the General Terms and Conditions of Grand Resort Bad Ragaz AG for all medical, therapeutic, diagnostic and consulting services of the Tamina Health Center of Grand Resort Bad Ragaz AG (hereinafter: Tamina Health Center), regardless of the type of booking (in person, by telephone, online, or by e-mail). This includes in particular all individual services, programs, individually compiled programs, add-ons, individual modules, and cure stays offered at the Tamina Health Center.
Parts of the Tamina Health Center’s services may be provided by internal or external medical partners. If the service is provided in the name and on the account of the Tamina Health Center, these GTC apply without restriction. If the service is provided in the name and on the account of external medical partners, then their contractual conditions shall apply.
1.2. Delimitation
For purely wellness, relaxation, and spa offers at the Grand Resort Bad Ragaz (e.g. classic massages, cosmetic treatments, Beauty & Spa services), the General Terms and Conditions of the respective service providers apply (e.g. the General Terms and Conditions of Grand Resort Bad Ragaz AG or the General Terms and Conditions of Tamina Therme AG).
In the event of any contradictions between different applicable terms and conditions, for services of the Tamina Health Center the provisions of these General Terms and Conditions shall take precedence.
2. SERVICES
The Tamina Health Center offers a comprehensive range of medical, preventive, therapeutic and diagnostic services according to the current state of science and medicine. All programs and treatments serve the purposes of prevention, regeneration and – where indicated – curative treatment. Their contents can be adjusted at any time to the individual needs and medical requirements of the guest.
The Tamina Health Center reserves the right to adjust or change the scope of services if medically necessary or for organizational reasons. Despite proper and professional implementation, no particular health success can be guaranteed.
The services are intended for both local guests/patients (e.g. within the scope of physician-prescribed therapies, individual treatments or diagnostics) as well as hotel guests of the Grand Resort Bad Ragaz.
3. CONCLUSION OF CONTRACT
A binding contract is concluded as soon as the Tamina Health Center confirms the guest’s booking in writing or electronically (e.g. by e-mail). By making the booking, the guest acknowledges these GTC as binding.
Depending on the booking method, consent to these terms is given as follows:
- Online bookings: The guest gives consent by actively clicking a checkbox to accept these terms.
- Bookings by e-mail: The GTC are provided with the offer; the guest’s acceptance of the offer is deemed agreement to the GTC.
- On-site bookings: Consent is given by countersigning the offer or by signing the information and consent form.
- For minors: The written consent of the legal representatives is required.
These GTC are an integral part of every contract. Any deviations or additions to the agreement must be confirmed in writing by the Tamina Health Center to be effective.
4. MEDICAL CONSULTATION & HEALTH INFORMATION
Before the start of any medical services, a medical consultation for information and assessment is strongly recommended.
For the provision of medical services with a physician’s prescription based on a referral, the mandatory consultation at the Tamina Health Center is waived. However, the patient remains obliged to provide the treating professionals at the Health Center with complete and truthful information regarding all relevant health data.
For the provision of medical services without a physician’s prescription, the medical consultation to assess the guest’s health status and possible risks is obligatory. If the guest chooses not to undergo this consultation or provides incomplete or false information about their health condition, medication, allergies, or pre-existing conditions, participation in programs and treatments is at the guest’s own responsibility. In such cases, the Tamina Health Center assumes no liability for any resulting health consequences.
5. DOCUMENTATION OF CONSENT
The performance of medical and therapeutic services requires the prior consent of the guest. This consent may be documented in different forms:
- Online bookings: By actively checking a designated box, the guest expressly declares their agreement to the booked services.
- Bookings by e-mail: By accepting the offer in writing, the guest provides their consent to the services.
- On-site bookings: Consent is given by countersigning the offer or by signing the information and consent form.
- For specific medical services or high-risk measures: Consent must in every case be given in writing by means of a separate consent form.
Without documented consent, the corresponding services may not be provided. By giving consent, the guest confirms that they have been informed about the nature, scope, purpose, possible risks, and alternatives of the intended measures.
6. PRICES & PAYMENT TERMS
All services of the Tamina Health Center are charged to the guest. The Tamina Health Center will not bill health or other insurance companies directly (exception: accident insurance). The guest is responsible for clarifying any potential cost coverage or reimbursement with their insurance company before the start of treatment.
6.1. Medically prescribed services for guests/patients residing in Switzerland
Medically prescribed services for which a prior guarantee of cost coverage (Kostengutsprache) exists will be billed according to the tariffs legally in force (e.g. TARMED). Invoices must be paid within 30 days of the invoice date, without deduction. For hotel guests, the invoice is issued separately (not charged to the hotel bill) and sent directly to their home address.
6.2. Medical services without a physician’s prescription for guests/patients residing in Switzerland
Services of the Tamina Health Center that are not carried out on the basis of a physician’s order or for which no cost coverage guarantee exists before treatment, as well as the Healthy Living programs (including add-ons), are billed according to the applicable price list. Invoices must be paid within 30 days of the invoice date, without deduction. For hotel guests, these charges will appear on the hotel bill.
6.3. Medical services for guests/patients not residing in Switzerland
Services of the Tamina Health Center are charged at the self-pay rate according to the price list to guests/patients from abroad. For hotel guests, these charges will be added to the hotel bill.
6.4. Healthy Living Programs
After booking a Healthy Living program, a deposit of 50% of the total price must be paid within 3 working days. The remaining balance is due at the latest upon arrival. For bookings made less than 14 days before the program start date, the total amount is due immediately in full.
6.5. General Provisions
All prices are quoted in Swiss Francs (CHF) and include statutory VAT, unless stated otherwise. The prices cover only the medical services and do not include hotel accommodation or meals. Upon request, the Tamina Health Center will issue the guest a detailed invoice for medical services for submission to their health insurance or insurer. However, no guarantee is given that the insurance will recognize or reimburse any of the costs (whether in full or in part).
7. CANCELLATION CONDITIONS
7.1. Single appointments (medical services, therapies)
Cancellations can be made free of charge up to 24 hours before the scheduled appointment. Medical individual services that have been booked and confirmed must be paid for in full by the customer in the event of a no-show (failure to appear at the appointment).
7.2. Healthy Living Programs
For cancellations up to 22 days before the scheduled arrival date, the deposit paid (50% of the total price) will be refunded in full. For cancellations between 21 and 15 days before the arrival date, the deposit will not be refunded. For cancellations 14 days or less before arrival, or in case of no-show, the entire price is payable in full. If a medical certificate is provided as justification for the cancellation, the amounts due can be credited as a voucher toward a later stay within one year.
8. GROUNDS FOR EXCLUSION
The Tamina Health Center is entitled to exclude guests from treatments or programs if:
- Medical reasons prevent the safe conduct of the service – in particular, acute infections, fever, decompensated cardiovascular conditions, or other contraindications which, in the professional judgment of the staff, could pose a risk to the guest’s health; or
- Guest’s conduct significantly disrupts the proper course of the treatment, violates generally accepted rules of conduct or the house rules, or causes a danger to personnel, other guests, or third parties.
In such cases, the guest has no claim to compensation or reimbursement for services already provided, unless mandatory legal provisions expressly dictate otherwise.
9. LIABILITY
The liability of the Tamina Health Center is excluded to the extent permitted by law (Art. 100 of the Swiss Code of Obligations). In particular, the Tamina Health Center is not liable for slight negligence, for the actions of auxiliary persons or substitutes engaged, for loss of profit, or for any further direct or indirect consequential damages.
This limitation of liability does not apply to damages to life, body, or health that are caused by intentional or grossly negligent conduct. Any liability for injuries caused by the guest’s own fault or for consequences of incomplete health information provided by the guest, which fall under the guest’s responsibility, is also excluded.
10. SEVERABILITY CLAUSE
Should any provision of these GTC be or become invalid, void, or unenforceable, the validity of the remaining provisions shall not be affected. In place of the invalid, void, or unenforceable provision, a provision shall be deemed to be agreed that comes as close as legally possible to the economic purpose of the original provision. The same applies in the event of any contractual gap.
11. APPLICABLE LAW AND JURISDICTION
These terms and conditions are governed exclusively by Swiss law.
The place of jurisdiction for all disputes arising from or in connection with these GTC and the services offered is – insofar as legally permissible – Bad Ragaz (Canton of St. Gallen, Switzerland).
