1. Scope and Delineation
1.1. These General Terms and Conditions (GTC) of the Tamina Health Center apply in addition to the equally applicable GTC of Grand Resort Bad Ragaz AG. They apply to all medical, therapeutic, diagnostic, and consulting services provided by the Tamina Health Center of Grand Resort Bad Ragaz AG (hereinafter: Tamina Health Center), regardless of the type of booking (in person, by telephone, online, by email). This includes, in particular, all individual services, programs, individually tailored programs, add-ons, individual modules, and spa stays offered at the Tamina Health Center.
1.2 Some of the services provided by the Tamina Health Center may be provided by internal or external medical partners. If the services are provided on behalf of and for the account of the Tamina Health Center, these GTC apply without restriction. If the services are provided on behalf of and for the account of external medical partners, their contractual GTC applies.
1.3 For pure wellness, relaxation and spa offers at the Grand Resort Bad Ragaz (e.g., classic massages, cosmetic treatments, beauty & spa services), the GTC of the respective service providers (e.g., GTC of Grand Resort Bad Ragaz AG or GTC of Tamina Therme AG) apply.
1.4 In the event of conflicts between different GTC, the provisions of these GTC shall take precedence for services provided by the Tamina Health Center.
1.5 The contract language is German. The Tamina Health Center provides a translation of these GTC in English. In the event of conflicts between the two language versions, the German text shall prevail.
1.6 The currently valid GTC can be accessed, saved, and printed at www.resortragaz.ch/en/tamina-health/tandc-tahc. Alternatively, a copy of these GTC can be requested at the reception desk.
2. Offer
2.1 The Tamina Health Center offers a comprehensive range of medical, preventive medical, therapeutic, and diagnostic services in accordance with the latest scientific and medical standards.
2.2 All programs and treatments are designed for prevention, regeneration, and, where indicated, curative treatment. The content can be adapted at any time to the individual needs and medical requirements of the Guest.
2.3 The Tamina Health Center reserves the right to adjust or change the scope of services if medically necessary or for organizational reasons. Despite professional execution, no specific health outcome can be guaranteed.
2.4 The services are aimed at both regional Guests/Patients (e.g., as part of medically prescribed therapies, individual treatments, or diagnostics) and Guests of the Grand Resort Bad Ragaz.
2.5 The telephone pre-stay consultation with a doctor or medical coach in the Longevity program is only available if the booking is made at least 14 days before arrival.
3. Conclusion of the Contract
3.1 A binding contract is concluded as soon as the Tamina Health Center confirms the Guest's booking in writing (e.g., by email). By making a booking, the Guest accepts these GTC as binding.
- Online bookings: Agreement by actively clicking on a selection field ("checkbox").
- Bookings by email: The GTC are sent with the offer; acceptance of the offer is deemed to be consent.
- On-site bookings: Countersigning of the offer or signing of the information and consent form.
3.2 For minors, consent in writing from their legal representatives is required.
3.3 The GTC are an integral part of every contract. Deviations or additions require confirmation in writing from the Tamina Health Center to be effective.
4. Medical Consultation & Health Information
4.1 A medical consultation is strongly recommended before the start of medical services.
4.2 For the provision of medical services with a doctor's prescription based on a medical referral, the mandatory consultation at the Tamina Health Center is not required. However, Patients remain obliged to provide the treating specialists at the Health Center with complete and truthful information about relevant health data.
4.3 For the provision of medical services without a doctor's prescription, the medical consultation to assess the state of health and possible risks is mandatory. If the Guest does not take advantage of this consultation or provides incomplete or incorrect information about their state of health, medication, allergies, or previous illnesses, participation in programs and treatments is at their own risk. In this case, the Tamina Health Center accepts no liability for any resulting health consequences.
5. Documentation of Consent
5.1 The provision of medical and therapeutic services requires prior consent of the Guest. This consent can be documented in various forms:
- Online bookings: By actively clicking on a selection field ("checkbox"), the Guest bindingly declares their consent to the booked services.
- Bookings by email: By accepting the offer in writing, the Guest declares their consent.
- On-site bookings: Consent is given by countersigning the offer or signing the information and consent form.
- For special medical services or risky measures, consent must always be given in writing using a separate consent form.
5.2 Without documented consent, the corresponding services may not be provided. By giving their consent, the Guest confirms that they have been informed about the nature, scope, purpose, possible risks, and alternatives of the measures.
6. Prices and Payment Terms
6.1 All services provided by the Tamina Health Center will be charged to the Guest. The Tamina Health Center does not settle accounts directly with health or other insurance companies (exception: accident insurance).
6.2 Guests are responsible for clarifying any possible cost coverage or reimbursement by their insurance company individually before the start of treatment.
6.3 Medically prescribed medical services for which a cost approval has been obtained prior to treatment will be billed in accordance with the legally valid tariffs (Tardoc, Physiotarif, etc.). The invoice is payable in full within 30 days of the invoice date. For Swiss hotel Guests, invoices are not included in the hotel bill but are sent directly to their home address.
6.4 Services provided by the Tamina Health Center that are not based on a doctor's prescription or for which no cost approval has been obtained prior to treatment, as well as the Tamina Healthy Living Programs including add-ons, will be billed at the self-payer rate according to the price list. The invoice is due in accordance with Art. 6.5 or Art. 6.6.
6.5 For Healthy Living Programs, a deposit of 50% of the total price must be paid within 7 days of booking. The remaining amount is due upon arrival at the latest. For bookings made less than 14 days before the start of the program, the total amount must be paid in full immediately.
6.6 All other medical services provided by the Tamina Health Center in accordance with the self-payer tariff will be billed to hotel Guests via their hotel bill. For external Guests/Patients, the invoice is payable in full within 30 days of the invoice date.
6.7 All prices are in CHF and include statutory VAT, unless otherwise stated. Prices include medical services only, but not hotel services. For Healthy Living Programs, meals are partially included in the medical program price as described in the program price. Upon request, the Tamina Health Center will issue the Guest with a detailed invoice for medical services for submission to their health insurance company or insurer. Any guarantee of (partial) reimbursement or recognition of the costs by the insurance company is expressly excluded.
7. Cancellation Policy
7.1 For individual appointments (medical services, therapies), cancellation is free of charge up to 24 hours before the agreed appointment. Individual medical services that have been booked and confirmed must be paid for in full by the Customer, even in the event of no-show.
7.2 For Healthy Living Programs, cancellations made up to 22 days before the arrival date will be refunded in full, including the 50% deposit. For cancellations between 21 and 15 days prior to the arrival date, the deposit paid will not be refunded. For cancellations 14 days or less prior to arrival or in case of no-show, the full price is due.
7.3 Upon presentation of a medical certificate, the amounts owed can be credited towards a future stay within one year.
8. Reasons for Exclusion
8.1 The Tamina Health Center is entitled to exclude Guests from treatments or programs if:
- there are medical reasons preventing them from participating, in particular acute infections, fever, uncompensated cardiovascular diseases, or other contraindications which, in the professional opinion of the Tamina Health Center, could pose a risk to the Guest's health, or
- the Guest's behavior significantly impairs the proper course of treatment, violates generally accepted rules of conduct or the house rules, or causes a danger to staff, other Guests, or third parties.
8.2 In such cases, there shall be no entitlement to compensation or reimbursement for services already rendered, unless otherwise required by law.
9. Liability
9.1 The liability of Tamina Health Center of GRBR AG is excluded to the extent permitted by law. GRBR AG is not liable for minor or moderate negligence, auxiliary persons or substitutes employed, loss of profit or other direct and indirect damages (including pure financial losses). Liability shall only exist in the event of intentional or grossly negligent damage caused by GRBR AG.
9.2 Liability for injuries caused by the Guest themselves or consequences of incomplete health information, which are the responsibility of the Guest, is excluded.
10. Severability Clause
10.1 Should individual provisions of these GTC be invalid in whole or in part, they shall be replaced by equivalent but effective provisions that come closest to the economic value of the invalid provisions. The validity of the remaining provisions shall not be affected.
11. Applicable Law and Place of Jurisdiction
11.1 Swiss law applies exclusively to the contractual relationship with the Customer (excluding the conflict-of-laws rules of international private law and the Vienna Sales Convention). The place of performance and exclusive place of jurisdiction for all disputes arising from or in connection with the contractual relationship is the municipality of Bad Ragaz.
